命价,作为法律名词,早在吐蕃时期的法律中就已经出现,而且当时已有了比较健全的制度。之后,随着藏区社会经济、政治和法律制度的进一步向前发展,命价的内容更加丰富,制度更加健全,其社会基础亦越来越坚实,进而成为藏族法律文化中的一个突出特点。不论是吐蕃王朝灭亡后的各个历史时期,还是在整个藏区被解放,人民当家作主之后,作为藏族法律文化重要内容的命价制度,在藏区发生的影响是十分深远的。由于其文化根基之深,普及范围之广,我们在当前的司法实践及理论研究中,不得不对它刮目相待。
As a legal term, the fate of price has already appeared in the laws of the Tubo period, and at that time a relatively sound system was in existence. Later, with the further development of socio-economic, political and legal systems in Tibet, the content of price-fixing is enriched, the system is more complete, and its social foundation is becoming more and more solid, thus becoming a prominent feature of Tibetan legal culture. Whether during the historical period after the death of the Tubo Dynasty, or after the entire Tibetan area was liberated and the people became the masters of the country, the impact of the system of pricing as an important part of Tibetan legal culture is very profound. Due to its profound cultural foundation and wide range of popularization, we have to treat it in the current judicial practice and theoretical research.
