构建和谐社会,需要法治来保障,乡村社会法制建设是法治建设的重要组成部分,也是当代中国实现法治的难题。在乡村社会法制建设过程中,需要妥善处理国家法和民间法的关系。羌族是我国少数民旅之一,习惯法在羌族乡土社会纠纷的解决中起着不可替代的作用,其存在具有一定的合理性、必要性。如何使习惯法在羌族社会发挥作用,进而克服因传统法文化断裂所引起的秩序缺失,是羌族地区法制构建亟待解决的问题,也是我国法治进程中不容忽视的重大课题。
To build a harmonious society requires the rule of law to ensure that the building of a socialist legal system in rural areas is an important part of the construction of the rule of law and is also a difficult issue for the realization of the rule of law in contemporary China. In the process of building a legal system of rural society, we need to properly handle the relationship between state law and civil law. The Qiang nationality is one of the minority brigades in our country. Customary law plays an irreplaceable role in the settlement of social disputes in the native Qiang area. Its existence has certain rationality and necessity. How to make customary law play a role in the Qiang society and then overcome the lack of order caused by the rupture of the traditional legal culture is an urgent issue to be solved in the legal system construction in Qiang area and also an important issue that can not be ignored in the process of rule by law in our country.
