荷兰关于侵权行为准据法的理论与实践体现了当代国际私法发展的新趋势。对于公路交通事故、产品责任、船舶碰撞、知识产权以及跨国环境污染等特殊侵权行为的法律适用,荷兰主张根据侵权行为的性质和种类,采用不同的准据法。荷兰的这些作法对侵全和完善我国国际私法的理论与实务具有一定的借鉴意义。
The Netherlands’s theory and practice of the law applicable to infringement reflects the new trend of the development of contemporary private international law. For the legal application of special infringements such as road traffic accidents, product liability, ship collision, intellectual property rights and transnational environmental pollution, the Netherlands maintains that different applicable laws should be adopted according to the nature and type of infringement. These practices in the Netherlands have some reference to the theory and practice of invading and perfecting our country’s private international law.
