宋代司法实践中,“原情定罪”和“罪疑惟轻”的现象极为普遍,这在一定程度上昭示出宋代司法精神的两个重要特点。文天祥的五篇判词所体现的法律思想主要是按照法律“原情定罪”、“罪疑惟轻”、法理与人情兼顾等原则进行判决,这既在一定程度上体现了文天祥的法律思想和个性特点,也与南宋时期司法裁判价值取向大体一致。
In the judicial practice in the Song Dynasty, the phenomenon of “conviction of the original love” and “suspicion of being light” was extremely common. This, to a certain extent, showed two important characteristics of the judicial spirit in the Song Dynasty.
