随着知识产权扩张和生物技术的发展,植物新品种权与农民权的冲突日益显现,如何协调二者关系事关发展中国家的国计民生和粮食安全。保护农民权具有重要的战略意义和经济价值,应在充分借鉴他国有益经验基础上,建立一套符合我国国情的新品种制度,切实保障我国种子安全和粮食安全,积极应对知识产权带来的挑战。
With the expansion of intellectual property and the development of biotechnology, conflicts between plant new varieties rights and peasant rights are becoming increasingly apparent. How to coordinate the relationship between the two is a concern for the national economy and the people’s livelihood and food security in developing countries. The protection of peasant rights has important strategic and economic value. Based on the full use of the beneficial experiences of other countries, it is necessary to establish a new breed system that is in keeping with China’s national conditions, effectively safeguard our country’s seed security and food security, and actively respond to the challenges posed by intellectual property .
