因住宅缺陷引起的纠纷在世界各国均是常见问题,英国默示担保制度在解决此类纠纷方面显现出较强的灵活性和旺盛的生命力。本文在分析英国合同法默示条款的基础上,结合判例研究了英国法院如何认定住宅缺陷的默示担保责任,以深化对默示担保制度在解决住宅质量纠纷方面重要作用的认识。
Disputes caused by residential flaws are common problems in various countries in the world. The British implied guarantee system shows strong flexibility and strong vitality in resolving such disputes. Based on the analysis of the implied terms of the UK contract law, this article studies how the British courts recognize the implied warranty of residential flaw and deepens the understanding of the important role of the implied warranty in resolving residential quality disputes.
