在日益激烈的市场竞争中,擅自使用知名商品特有名称、包装、装潢的不正当竞争案件出现的愈来愈多,如有影响的“小肥羊”“妇炎洁”“王老吉”等名称、包装、装潢纠纷等,因此类纠纷比较新颖,相关法律规定不尽完善,特别是对此类案件具体如何认定规定的不详细,加之知名商品特有名称、包装、装潢与其他关联权利的冲突,以及立法在赔偿责任和赔偿范围上的矛盾,时司法实践者在解决此类纠纷时,感到无所适从,力不从心,因此,迫切需要在理论上进一步细化、完善相关法律规定。
