司法权是国家权力体系中非常重要的一个组成部分,同时也是维系社会公正的最后防线,因此对司法权威的理解和树立对于一个国家的法治建设事业有着非比寻常的意义。本文旨从比较中西方历史传统的视角对我国司法权威涉及的几个问题加以探讨,从而挖掘出司法权威屡遭冲击的一些根本性内因,继而对法治建设进程中司法改革的大致方向加以思考和探索。
Judicial power is a very important part of the state power system and also the last line of defense to maintain social justice. Therefore, understanding and establishing judicial authority is of extraordinary significance to the rule of law in a country. This paper aims to explore some issues involved in the judicial authority of our country by comparing the perspectives of the Chinese and Western historical traditions so as to discover some fundamental internal causes of the repeated attacks on the judicial authority and then to consider the general direction of the judicial reform in the process of the legal construction explore.
