对我国法律援助制度的探讨,不应仅停留于具体的制度层面,而应上升到理论基础的高度。目前学界对法律援助制度理论进行基础性、前沿性、创新性研究较少,未能充分发挥理论的先导作用。为此,本文试图从价值基点、经济基石、政治基源、人文基础等方面对和谐社会法律援助制度的理论基础进行探讨。
The discussion of the legal aid system in our country should not only stay at the specific institutional level but rise to the theoretical level. At present, the academic research on legal aid system is basic, cutting-edge and innovative, and few studies have failed to give full play to the leading role of theory. Therefore, this article attempts to discuss the theoretical foundation of the legal aid system in a harmonious society from the point of value, the cornerstone of economy, the political basis, the humanities foundation and so on.
