民办高等教育是我国教育事业的重要组成部分,在推进我国高等教育大众化的进程中具有不可忽视的作用。然而由于我国相关法律法规不尽完善,民办高等教育在其发展过程中遭遇到了一些法律障碍。这些法律障碍在关于民办高等教育的立法观念、政策可行性、性质定位以及税收政策和产权归属等问题中表现突出。目前,只有尽快采取相应措施,合理地解决这些法律障碍,优化其发展的法律环境,才能促进我国民办高等教育快速、健康、稳定地发展。
Private higher education is an important part of China’s education and plays an important role in promoting the popularization of higher education in China. However, due to the imperfect laws and regulations in our country, private higher education has encountered some legal obstacles in its development. These legal obstacles are prominent in the issues of legislative concept, policy feasibility, nature of private higher education, tax policies and the ownership of property rights. At present, only by taking appropriate measures as soon as possible and properly solving these legal obstacles and optimizing the legal environment for their development can we promote the rapid, healthy and steady development of private higher education in our country.
