农村承包合同鉴证是指农村承包合同管理机关,根据合同双方当事人的自愿申请,对双方所订立合同的真实性、合法性进行审查的一种制度。鉴证虽然不是农村承包合同生效的法定要件之一,属当事人的自愿行为,但是通过鉴证程序的履行,却能够实实在在的保护当事人的合法权益和集体经济组织利益,为农村承包合同的顺利履行创造前提条件,合同鉴证可以起到四个方面的作用。
