“组织—意识”是贯穿于昂格尔法治命题的基本方法。昂格尔语境下法治的产生从组织上看是多元集团的出现,从意识上看是自然法学说的支撑。而采用“组织”与“意识”相结合的方法便是市民社会的产生与壮大。市民社会在组织上的表现是社会组织的发展与分化,在意识上表现为社会意识的理性化。因而将“组织”和“意识”相结合以壮大和发展中国市民社会是昂格尔法治命题对法治中国建设的启示。
“Organization - Consciousness ” is the basic method that runs through Unger’s proposition of the rule of law. The emergence of the rule of law in Ungole is organizationally pluralistic and appears to be the support of natural law from the perspective of consciousness. The combination of “organization ” and “consciousness ” is the emergence and growth of civil society. The performance of civil society in the organization is the development and differentiation of social organizations, and the rational manifestation of socialization is the rationalization of social consciousness. Therefore combining “organization” and “consciousness” to strengthen and develop Chinese civil society is the enlightenment of Ungel’s proposition on rule of law in China.
