“三包”是“退货、更换、修理”的简称,是经营者因提供的商品或者服务不符合质量要求而应当承担的民事责任。“三包”规定由来已久,新《消法》对“三包”规定进行了完善,扩大了“三包”规定的适用范围。在此背景下,对“三包”规定的具体实践以及新《消法》的“三包”规定在执行中可能遇到的问题做梳理和分析是非常有必要的。
“Three Guarantees ” is short for “Return, Replacement, Repair ” and is the civil liability that operators should bear because the goods or services they provide do not meet the quality requirements. The “Three Guarantees” regulation has a long history. The new “Consumer Law” has perfected the “Three Guarantees” provisions and expanded the scope of application of the “Three Guarantees” provisions. Against this background, it is very necessary to sort out and analyze the problems that may be encountered in the implementation of the “Three Guarantees” regulation and the “Three Guarantees” of the new Consumer Law.
