在亚里士多德有关法治的论述中,不仅可以看到法律层面的法治,而且可以看到价值层面和政体层面的法治,这就为我们分析社会主义法治与自由主义法治提供了一个基本框架。社会主义法治与自由主义法治在法律层面并无不同,但在政体层面和价值层面却有着根本差异。不仅如此,对于社会主义法治的整体分析还表明,社会主义法治是当今世界上唯一具有古典精神的法治形态。
Aristotle’s treatises on the rule of law can not only see the rule of law at the legal level but also the rule of law at the level of values and at the level of the political system. This provides us a basic framework for analyzing the rule of law in the socialist society and the rule of law in liberalism . Socialist rule of law and liberal rule of law in the legal level is no different, but there is a fundamental difference between the political level and the value level. Moreover, the overall analysis of the socialist rule of law also shows that the socialist rule of law is the only legal form with classical spirit in today’s world.
