刑罚适用的具体过程和后果,意味着剥夺、限制受刑人的现有的利益,并在不同程度上制造受刑人的身心痛苦,所以就要求刑罚的存在和人类的需要和社会需要相适应。笔者拟从历史入手,考察刑罚的起源,从人性需要出发,阐述刑罚权存在的必要性;从人类理性要求入手揭示刑罚与刑法基本原则的关系;进而展望我国刑罚的发展方向。
The specific procedures and consequences of the application of punishment mean deprivation, restriction of the existing interests of the torturer and, to varying degrees, the physical and psychological suffering of the torturer, thus requiring the existence of the penalty to be compatible with the needs of the community and social needs. I intend to start from the history, examine the origin of the penalty, starting from the needs of human nature, elaborating the necessity of the existence of the penalty right; starting from the human rational requirements to reveal the relationship between the penalty and the basic principles of criminal law; and then look forward to the development of China’s penalty direction.
