中国的反倾销立法始于20世纪90年代,在此之前,中国遭遇国外产品倾销时没有相应的法律,保护自己的正当权益。随着我国参与国际经济合作与发展的活动越来越频繁,某些国外产品以倾销方式进入中国市场的现象愈来愈严重,反倾销立法工作逐步提上日程。目前,中国作为世界贸易组织的成员,现行的反倾销法还很不成熟,同世界贸易组织《反倾销协议》还有相当的差距。同时现有的立法体例、实体性规则和程序性规则等方面存在许多缺陷,亟待根据世贸组织的反倾销规则进行修改和完善。
China’s anti-dumping legislation began in the 1990s, after China encountered no corresponding laws in dumping foreign products to protect its own legitimate rights and interests. As China’s participation in international economic cooperation and development is more and more frequent, the phenomenon that certain foreign products enter the Chinese market by dumping is becoming more and more serious, and the anti-dumping legislative work is gradually put on the agenda. At present, as a member of the World Trade Organization, China’s current anti-dumping law is still immature. There is still a considerable gap between China and the World Trade Organization’s “anti-dumping agreement.” At the same time, there are many shortcomings in the existing legislative system, substantive rules and procedural rules. It is urgent to revise and improve according to the WTO anti-dumping rules.
