当今的刑事政策是现实与逻辑演绎的结果,不依个人的意志为转移。具体表现为全球主要国家市场经济的发展促成市民社会的发达,由此引出国家权力分割及公民权利扩张,并以分权监督与制约为制度保障,自近代以来的自由、平等、博爱、公平、公正、效率、宽容、宽恕、人道等成就了普世价值观,法理学研究的前沿理论奠定了刑事政策的根基。全球一体化下的刑事政策成为必然。
Today’s criminal policy is the result of realistic and logical deductions, and does not depend on the individual’s will.
