历经24载春秋,《中华人民共和国电信法》据说就要结成正果。有人欢欣鼓舞,有人满怀疑惑,一部行业基本法规,承载了太多的期望。纵观各国历史,电信业的法制进程无不充满坎坷,这不仅与技术进步、市场结构等行业特性相关,也与各国政治经济体制和政府经济管理职能相关。出台不易,执行不易,完善更难。没有人会怀疑中国电信业必然会走上依法治理、依法监管的方向,但法律制度体系、执法队伍建设和监管效率等关键问题依然处于迷雾之中。
After 24 years of Spring and Autumn, the “Telecommunications Law of the People’s Republic of China” is said to have come to fruition. Some people are encouraged, some are full of doubts, an industry basic laws and regulations, carrying too much expectations. Throughout the history of all countries, the legal process of the telecommunications industry is full of bumps. This is not only related to the industrial characteristics such as technological progress and market structure, but also to the functions of the political and economic systems and the government’s economic management in various countries. Introduced is not easy, the implementation is not easy, perfect more difficult. No one doubts that China’s telecom industry will inevitably embark on the principle of governing according to law and supervising according to law. However, the key issues such as the legal system, law enforcement team building and regulatory efficiency are still in the fog.
