《行政诉讼法》修改在即,而其规定除赔偿诉讼外均禁止适用调解。为解决行政争议,缓和行政机关与行政相对人之间的对立与紧张关系,有些学者主张从立法上增设行政诉讼调解制度,但是调解制度本身追求解决纠纷,有时甚至以牺牲法律原则为代价。我国的行政诉讼调解制度无论从适用背景、范围、程序还是整个理念、发展历程都与域外相类似的和解制度不同,在我国确立行政诉讼调解制度,不仅会弱化司法机关的司法审查权,降低司法权威,而且还会破坏权力制衡机制,不利于尊重和保障公民权利,因此我国当前不适宜增设行政诉讼调解制度。
The revision of the Administrative Procedure Law is imminent, and its provisions prohibit the application of mediation except for compensation proceedings. In order to solve administrative disputes and ease the antagonism and tension between the executive and the administrative counterparts, some scholars advocate the establishment of an administrative mediation system from the legislative point of view. However, the mediation system itself pursues the resolution of disputes and sometimes at the expense of legal principles. The administrative reconciliation system in our country is different from the reconciliation system similar to the extraterritorial scope in terms of its applicable background, scope, procedure or whole idea and its development course. Establishing administrative mediation system in our country not only weakens the judicatory judicial review authority and reduces the judicial Authority, but also undermines the mechanism of power checks and balances, is not conducive to respect and safeguard the rights of citizens, so our country is not appropriate to create an administrative litigation mediation system.
