宽严相济的刑事政策是党的一项基本刑事政策,是在以人为本的科学发展观指导下,科学判断犯罪态势与社会发展关系的基础上所作的新思考、所提的新理念。认真执行宽严相济的刑事政策,最大限度地减少社会对立面,是维护社会稳定,构建社会主义和谐社会的基础。本文笔者现结合三年来的审判实践谈一下对宽严相济刑事政策的认识和感受。
The criminal policy of tempering justice with mercy is a basic criminal policy of the party. It is a new thinking based on the scientific judgment of the relationship between the crime situation and social development under the guidance of the people-oriented scientific concept of development. Earnestly implementing the criminal policy of leniency and strictness to minimize the social opposition is the basis for maintaining social stability and building a harmonious socialist society. The author of this article is now combined with three years of trial practice talk about the criminal policy of temper justice with feelings of understanding and feelings.
