由最高人民法院民二庭、中国人民大学法学院破产法研究中心、北京市高级人民法院民二庭、中国政法大学破产法与企业重组研究中心、北京炜衡律师事务所等单位共同举办的“第一届中国破产法论坛”已于2008年5月31日至6月1日在北京友谊宾馆隆重举行,来自全国的400多名法官、律师、注册会计师、破产清算师、专家学者以及大型企业和金融机构的代表参加了论坛,社会各界反响很好。本届论坛集中了企业破产法实践中的热点和难点问题,主要围绕上市公司重整制度的构建,金融机构破产的立法模式和特殊制度,关联企业破产问题,破产管理人制度以及公司清算制度与破产程序的衔接等重要问题展开。论坛共收到论文145篇,我们摘选部分论文与读者共享。
By the Supreme People’s Court Minzhunting, Renmin University of China Law School Bankruptcy Law Research Center, the Beijing Higher People’s Court Minzhunting, China University of Political Science Bankruptcy Law and Enterprise Restructuring Research Center, Beijing Wei Heng law firm co-sponsored by The 1st China Bankruptcy Law Forum was held in Beijing Friendship Hotel from May 31 to June 1, 2008. More than 400 judges, lawyers, certified public accountants, bankruptcy liquidators, experts and scholars from across the country Representatives of large enterprises and financial institutions participated in the forum and the response from all walks of life was very good. The forum focused on hot and difficult issues in the practice of corporate bankruptcy law, focusing on the establishment of the reorganization system of listed companies, the legislative mode and special system of bankruptcy of financial institutions, the bankruptcy of affiliated enterprises, the system of bankruptcy supervisors and the liquidation system of the Company The convergence of bankruptcy procedures and other important issues started.
