一、快件延误时的法律保护将快件快速送达收件人是快递企业承担的最重要合同义务之一。《国家标准》规定:除特殊约定外,同城快递应在一个自然日内送达;国内异地快递应在三个自然日送达;而港澳台快递则应在六个自然日内送达。快件延误的时限,即快递企业承诺的送达时限期满后到用户可将快件视为丢失的期间。《国家标准》对快件延误的时限细化为一般延误和彻底延误。当快件发生延误时,消费者可依《合同法》第一百零七条向快递企业主张违约责任,要求其赔偿由于投递延误带来的损失。要约等时效性较强的商业函件、易腐物品等因为延误导致快件直接价值损失的,消费者应获得与
