党的领导是依法治国的根本保证,立法工作是依法治国的基础工作。《中共中央关于加强党的执政能力建设的决定》强调加强党对立法工作的领导,并且特别要求善于使党的主张通过法定程序成为国家意志,从制度上、法律上保证党的路线方针政策的贯彻实施,使这种制度和法律不因领导人的改变而改变,不因领导人看法与注意力的改变而改变。这里我们理解,党的主张应当是党的立法主张,包括修改法律主张,而非其他政治、经济主张。而党的主张通过法定程序成为国家意志,
Party leadership is the fundamental guarantee for governing the country according to law. Legislative work is the basic work of governing the country according to law.
