对不可克减的权利的保护是人权保护的重要内容。建立不可克减的权利制度,对于协调公共利益与个人利益的冲突,维护法治原则,加强人权保护具有重要的意义。我国人权保护事业的发展为建立不可克减的权利制度提供了良好的生存环境,现有紧急状态法律制度的发展为建立不可克减的权利制度提供了制度保障。未来我国不可克减的权利制度的建立应该通过统一、完善现有紧急状态制度,将不可克减的权利明确规定于宪法中以及完善不可克减的权利的救济制度来实现。
The protection of non-derogable rights is an important part of human rights protection. Establishing a system of non-derogable rights is of great significance for the coordination of conflicts between public interests and personal interests, safeguarding the principle of the rule of law and strengthening the protection of human rights. The development of human rights protection in our country provides a good living environment for the establishment of the non-derogable right system. The development of the existing emergency legal system provides the system guarantee for the establishment of the non-derogable right system. In the future, the establishment of the non-derogable right system in our country should be realized by unifying and perfecting the existing emergency system, specifying the non-derogable right in the constitution and improving the relief system of non-derogable rights.
