贺海仁先生在《无讼的世界:和解理性与新熟人社会》一书中,试图通过对社会结构的重新注解,构建新熟人社会的概念,为非诉讼纠纷解决方式提供更充实的社会学理论基础。其从社会分工及职业团结、建立社会关系的自由、拟制的亲属路线等角度深入论证了新熟人社会的内涵及四种具体存在形态,从而达到“为非诉讼解决机制提供认识论上的切入点”及“对现代社会现实提供一种进一步的解说”的写作目的。本文在深入分析新熟人社会形成的根本原因、基本形态、边界和性质以及其对纠纷当事人选择纠纷解决方式的意义后,提出形成新熟人社会的根本原因在于人们在社会变迁的背景下对安全和发展的需求:新熟人社会乃同质性与异质性兼存且异质性更为明显的社会结构,明显的异质性是其与传统熟人社会的重要区别;新熟人社会乃一个不断向外延伸的开放式社会,外部边界的扩大化及模糊化是其与传统熟人社会的另一重要区别;在交易成本的视角下,非诉纠纷解决机制在新熟人社会中的交易成本呈现不同的变化趋势等观点,从而为进一步完善其理论提供可能的方向。
