原告刘某原受聘于一乡镇计生服务站工作。计生服务站属事业单位。2003年11月下旬。刘某请假休息,假满后于12月15日向单位请求续假半月。在此期间.刘某于12月1日与另一乡的计生服务站签订了聘用合同,并已在该单位上班。刘某于2004年2月向原单位提出回去上班,未得允许,双方产生纠纷。因企业改制,实行停薪留职,期限届满后,停薪留职的员工不回单位上班;有的没有书面辞职请求,即离开企业长达几年或十几年.而企业没有对其作出过辞退、解除劳动合同的处理;或者有的企业作出处理决定后,只在企业会议上公布,或者只在厂
