本文论述了简明英语运动及文化对日本银行与英美银行贷款合同方面的影响。主要从以下方面进行阐述:一方面是所辖法律系统的差异,即大陆法系(影响日本法)与英美法系的差异。另一方面是美国20世纪70年代开展的简明英语运动与其他国家的对比。本论文分别从明晰、简洁、完成、可读性、权利与义务这五个方面考察了日本银行与英美银行贷款合同的不同。合同所反映的固有文化尤其体现了日本人对制定法律文书的态度。这对法律文书具有重要的影响。业务人员制定的贷款合同无意识中也可以反映出高语境的日本文化与低语境英美文化之间的差异。通过对比分析英国、美国及日本所使用的贷款合同,可以发现上述因素对贷款合同的影响。
This article discusses the impact of Concise English Movement and Culture on the loan contracts between Japanese banks and Anglo-American banks. Mainly from the following aspects: On the one hand, is the difference of the legal system under the jurisdiction, that is, the civil law system (affecting Japan law) and Anglo-American legal system differences. On the other hand, the concise English movement carried out by the United States in the 1970s contrasts with other countries. This dissertation examines the difference of loan contracts between Bank of Japan and Anglo-American Bank from the following five aspects: clarity, conciseness, completion, readability, rights and obligations. In particular, the inherent culture reflected in the contract reflects the Japanese attitude toward the development of legal instruments. This has a significant impact on legal instruments. The unconsciousness of loan contracts set by business people can also reflect the differences between high-context Japanese culture and low-context Anglo-American culture. By comparing the loan contracts used by the United Kingdom, the United States and Japan, we can find the impact of the above factors on loan contracts.
