“市场经济是信用经济”。信用环境的好坏直接关系到我国市场经济能否健康有序的发展。学界对此极为关注,经济学家们纷纷从信用体系入手来构建我国市场经济下的信用体系;法学家们则试图从法律的视角来思考如何保护权利主体的信用权以缔造整个社会信用环境。那么,市场经济下的信用权究竟是一种什么性质的民事权利?对此却众说纷纭。然而,对其能否准确定位不仅是一个理论问题,更重要的是它关系到信用权制度的构建以及能否得到充分保护。
“Market economy is credit economy.” The quality of the credit environment is directly related to the healthy and orderly development of China’s market economy. The academic circles are very concerned about this. Economists have started from the credit system to build a credit system under the market economy in our country. Jurists try to think about how to protect the credit rights of rights subjects from the perspective of law so as to create the entire social credit environment. So, what is the nature of the civil rights under the credit market in the market economy? There are different opinions. However, its accurate positioning is not only a theoretical issue, more importantly, it relates to the construction of the credit right system and whether it can be fully protected.
