公民新闻是指普通公民通过大众传播媒介自主、自发地传播的新闻资讯。从法权属性看,公民新闻是表达权、监督权与参政权的实现。从法治价值看,公民新闻具有揭示执法真相、规范行政执法以及推动法治进步的作用。近年来,公民新闻取得快速发展,但也面临重要的法制困境,遭遇新闻失真、侵权与权利冲突等问题。刑法、行政法与诉讼法的完善可以为公民新闻提供“硬法”规范,而实名制、道德规范与职业规范可以为公民新闻的调整提供“软法”支持,通过“软硬兼施”的法律调整,公民新闻的发展会更健康。
Citizen news refers to the ordinary citizens through the mass media independent and spontaneous dissemination of news and information. From the perspective of legal rights, citizen news is the realization of right of expression, supervision and participation. Judging from the value of the rule of law, citizen news has the function of revealing the truth of law enforcement, standardizing administrative law enforcement and promoting the progress of the rule of law. In recent years, citizen journalism has made rapid progress, but it also faces important legal difficulties and encounters such issues as news distortion, infringement and conflict of rights. The improvement of criminal law, administrative law and procedural law can provide “hard law” norms for citizen news, while real name system, moral norms and professional norms can provide “soft law ” support for the adjustment of citizen news through "The legal adjustment, the development of citizen journalism will be more healthy.
