美术作品是知识产权法中特殊的知识产权客体,其著作权人的著作权与作品所有人的所有权之间有特殊的关系。即,被转让美术作品的权利有两类:一是原件所有人的所有权,二是美术作品创作人的著作权。当这两类权利分属不同的权利主体的时候就有权利冲突的发生。集中于美术作品上的所有权与著作权的关系是本文力图探讨的主题。
Art works are the special intellectual property objects in the law of intellectual property. There is a special relationship between the copyright of the copyright owner and the owner of the work. That is, there are two types of rights to be transferred to a work of art: one is the ownership of the original owner and the other is the copyright of the creator of the artwork. When these two types of rights belong to different subjects of rights, they have the right and the right to conflict. The focus on the relationship between the ownership of works of art and copyright is the subject of this article.
