深化文化体制改革把文化产业市场化发展的有关问题推到了法学研究的前沿,特别是向与市场经济紧密联系的竞争法提出了新的课题。论文以文化产业区别于其他一般经济领域的特殊性为切入点,结合西方国家的立法和法律实践经验,阐明文化产业的市场化经营必须依靠竞争法调整和保障的立场,重点概括和分析了发展文化产业给反垄断法制建设提出的新要求,以期待正在制定中的我国反垄断法能就与文化产业发展有关的竞争问题作出相应的规定,为文化产业的市场化改革和发展提供法律保障。
Deepening the reform of the cultural system pushed the relevant issues of the market-oriented development of cultural industries to the front of jurisprudence research, especially the competition law that is closely linked with the market economy. Taking the particularity of cultural industry different from other general economic fields as the starting point and combining with the experience of legislation and practice in western countries, this paper expounds that the market-oriented operation of cultural industries must rely on the position of adjustment and guarantee by competition law, and summarizes and analyzes the development It is hoped that the anti-monopoly law under development in China will make corresponding provisions on the competition issues related to the development of cultural industries and provide legal protection for the market-oriented reform and development of cultural industries.
