随着经济发展,交易越发频繁,当事人在一定期间内基于继续交易而发生债权债务关系的情形也经常出现,如果以普通抵押权担保此类交易活动所产生的债权,将会给当事人带来繁琐的事务从而难以顾及给市场经济环境中的交易安全和效率带来极大的不便和阻碍。在经过长时间的实践和总结后,为担保长期继续交易或融资所产生的债权的需要,产生了最高额抵押权制度,不过我国《担保法》中对于最高额抵押权制度的规定由于缺乏理论和实践上的支持,存在较大缺陷。但随着《物权法》对最高额抵押权制度有了新的诠释,为其在现实经济生活中更好发挥作用提供了更加有效有力的依据。

However, as the Property Law provides a new interpretation of the maximum mortgage system, it provides a more effective and powerful basis for its role in the actual economic life.
