“正当防卫”是我国刑法中设立的一项重要法律制度,是正当行为的一种,是法律赋予公民同违法犯罪行为作斗争的一种重要权利和手段,是法律赋予公民在国家、公共利益、本人或他人的人身、财产和其他权利受到不法侵害时可采取的正当行为。其目的是鼓励公民与正在进行的不法侵害作斗争,从而保障社会公共利益及公民的合法权利免受正在进行的不法侵害。
“Legitimate Defense ” is an important legal system set up in criminal law in our country. It is a kind of legitimate act, an important right and means that the law confers on civilians to fight criminal activities, Public interest, legitimate acts that may be taken when the personal, property and other rights of oneself or others are unlawfully infringed. Its purpose is to encourage citizens to fight against ongoing unlawful violations, thereby safeguarding the public interest in society and the legitimate rights of citizens against ongoing unlawful violations.
