本文论述了罢免制度的理论基础和实践意义,描述了罢免制度运作的现状,进而分析了罢免制度的症结所在,着重分析了罢免制度中的程序缺陷。通过对各省级村委会选举地方性法规的比较研究、近年来村委会罢选案例的实证分析、学术界罢免程序研究成果的学理探讨和部分地方罢免程序创新的制度借鉴,归纳出罢免程序三个阶段十二个争议较大的问题并提出了相关的对策。最后提出了与罢免制度有关的立法建议,希望在《村民委员会组织法》修订过程中能够完善罢免制度,保护村民的罢免权,加强对村委会的监督,确保村民自治的顺利进行。
This article discusses the theoretical basis and practical significance of the recall system, describes the status quo of the operation of the recall system, and then analyzes the crux of the recall system, emphasizing the analysis of procedural defects in the recall system. Through the comparative study of the local laws and regulations of the election of the village committees at various provincial levels, the empirical analysis of the cases of village committees dismissal in recent years, the academic exploration of the research results of academic dismissal procedures and the system of some local dismissal procedures, Twelve issues of controversial issues in the three stages of the process and put forward relevant countermeasures. At last, I put forward the legislative suggestion related to the recall system. I hope that in the process of revising the Organic Law of the Villagers ’Committee, the system of recalling can be improved, the villagers’ right of recall can be protected, the supervision over the village committee can be strengthened and the self-government of villagers can be carried out smoothly.
