近几年来,多元化的纠纷解决机制得到了许多法律工作者的关注和讨论,尤其是法院调解这种结案方式对纠纷解决和维护社会稳定的重要意义更是毋庸置疑。但法院调解制度在不同地区的适用情况有所不同,这当然是与社会条件密切相关。法律社会学作为法学的边缘学科,就是专门研究法律与社会学间关系,特别是社会条件对法律制度的影响。
In recent years, a wide range of dispute resolution mechanisms have attracted the attention of and discussions by many legal workers. In particular, it is no doubt that the court mediation method of settling disputes is of great significance to the resolution of disputes and the maintenance of social stability. However, the application of the court mediation system in different regions is different. This of course is closely related to the social conditions. As a marginal discipline of law science, legal sociology specializes in the study of the relationship between law and sociology, especially the influence of social conditions on the legal system.
