法律援助是国家保障司法人权和司法公正的不可缺少的重要手段,是现代国家对公民承诺的一项基本义务。我省的法律援助制度自建立以来,为经济困难群体、特殊案件当事人提供了平等法律帮助,为保障司法人权做出了积极贡献。但实践中还存在不少缺陷亟待完善,包括制度建设以及法律援助队伍建设等。本文主要分析我省法律援助的现状、特点及存在的弊病,并从三个方面提出构建符合本地实际状况的法律援助机制,以期进一步发挥该制度的司法人权保障功能。
Legal aid is an indispensable and important means for the country to protect the human rights and judicial justice of the judiciary. It is also a basic obligation of the modern nation to promise to its citizens. Since its establishment, the system of legal aid in our province has provided equal legal help to the economically disadvantaged groups and special cases parties and made positive contributions to the protection of judicial human rights. However, there are still many shortcomings in practice, such as system construction and legal aid team construction. This article mainly analyzes the present situation, the characteristics and the shortcomings of the legal aid in our province, and puts forward the legal aid mechanism in line with the actual conditions of our country from three aspects in order to further exert the judicial human rights guarantee function of the system.
