随着我国由计划经济体制向市场经济体制的转变,企业间人才的流动日益频繁。并且,随着市场经济体制的日益完善,企业用人制度的不断改革,这种流动将越来越带来普遍性。企业间人才的流动同时也带来了知识、甚至知识产权的流动。当前,由于我国企业还普遍缺乏有关经验,相关立法的滞后以及企业领导及有关人员法律意识的淡薄,使知识产权的流动有很大的无序性和危害性,极大地危害了有关企业的合法权益。例如,我国VCD行业的发展迅速,生产厂家众多,其中有很多新生企业是由从原有的VCD企业中流动出来的人才为骨干发起并组建的。其中原有企
