在当今中国经济社会转型期,社会矛盾频发。研究加强和创新社会管理的途径和措施、构建法治型社会管理模式,具有十分重要的现实意义和深远影响。要求我们必须准确把握社会管理的法治属性,正视当前社会管理中存在的矛盾和问题,从创新社会管理法治理念、创新以政府转型为重点的行政管理体制、创新社会管理主体多元化格局保障机制、创新司法公正保障与法律救济机制、创新利益诉求表达及社会矛盾调处机制等角度入手,探寻加强与创新社会管理的法治之道,最终建立以“善治”为主要特征的和谐社会。
In the current economic and social transition in China, social conflicts are frequent. Studying ways and measures to strengthen and innovate social management and building a rule of law social management model have very important realistic and far-reaching implications. It requires that we must accurately grasp the legal attribute of social management, address the contradictions and problems in current social management, innovate the concept of governing the rule of law in society, innovate the administrative management system focusing on the transformation of the government, innovate the guarantee mechanism for the diversified structure of social management entities, Innovate judicial justice guarantee and legal remedy mechanism, expression of innovative interest demands and social mediation and mediation mechanism, explore ways to strengthen and innovate the rule of law in social management, and finally establish a harmonious society with “good governance ” as the main feature.
