案例教学法凭借其多样性、灵活性、趣味性等特征,被广泛应用于法律教育领域。案例教学法在我国民商法中的引用,在一定程度上弥补了传统讲授教学法的不足,尤其是通过加强师生互动,有效提升了学生理论与实际相结合的能力。就目前我国的民商教学而言,在应用案例教学法的过程中应以培育学生的法律思维作为核心,并通过科学设置民商法课程全面提高学生的法律职业技能。基于此,文章拟从科学选用案例、开展模拟审判、组织分组讨论这三个层面,对案例教学法在民商法中的具体应用进行深入探讨。
Case teaching method is widely used in legal education because of its characteristics of diversity, flexibility and interest. The quotation of case teaching method in China’s civil and commercial law, to a certain extent, makes up for the shortcomings of the traditional teaching method of teaching, especially by strengthening the interaction between teachers and students, effectively enhancing the students’ ability to combine theory with practice. At present, in terms of civil and commercial teaching in our country, we should take cultivating students ’legal thinking as the core in the process of applying case teaching method and improve students’ legal vocational skills comprehensively by setting civil and commercial law courses scientifically. Based on this, the article intends to explore the specific application of case teaching method in Civil and Commercial Law from the three aspects of selecting cases of science, simulating trial and organizing group discussion.
