网络证据的审查判断对认定案件事实具有十分重要的作用。网络证据附属信息是审查判断网络证据的重要方法和途径。网络证据的附属信息是指在对网络证据进行审查判断时,网络证据本身所包含的证据信息之外的,能够影响网络证据本身可采性的信息。网络证据的附属信息具有合法性、关联性和综合性三个基本特征。加强对网络证据附属信息的研究对于认定网络证据的真实性、可采性以及当事人的举证责任等都具有重要的研究价值。
The examination and judgment of the network evidence plays a very important role in the facts of the case. Network evidence attachment information is an important way to examine and verify network evidence. Ancillary information of network evidence refers to the information that can influence the admissibility of the network evidence in addition to the evidence information contained in the network evidence when the network evidence is examined and judged. Ancillary information of cyber evidence has three basic characteristics: legitimacy, relevance and comprehensiveness. Strengthening the research on the attached evidence of cyber evidence is of great research value for the authenticity, admissibility and the burden of proof of the parties.
