职工因第三人侵权行为受到伤害导致工伤的,形成侵权损害赔偿与工伤保险待遇的竞合关系。职工主张的项目性质相同或相似,但不单纯以填补实际损失为目的的项目,以及项目性质不同且具有专属性的项目,工伤职工可主张获得双重全额赔偿;对于以填补实际损失为目的的财产性赔偿项目,职工只能获得有限双重赔偿。
