一、引言婚姻登記包括結婚登記、離婚登記及重婚登記。「領事婚姻登記」是指一國駐外國的外交、領事機構在不違反駐在國法律規章的前提下,應婚姻當事人的申請,依派遣國法律規章為其辦理婚姻登記並頒發相應證書的活動。隨著中國改革開放的不斷深入,中外人員的跨國流動日益頻繁,中國駐外領事辦理婚姻登記的數量亦越來越多。據統計,2011年中國駐外領事為具有中國國籍的雙方當事人辦理「領事婚姻登記」
I. Introduction Marriage registration includes marriage registration, divorce registration and registration of bigamy. Consular Marriage Registration refers to the activity of a diplomatic and consular institution of a foreign country that applies for registration of marriage and issues corresponding certificates according to the application of the marriage party and its laws and regulations of the sending State, without violating the laws and regulations of the host country. With the continuous deepening of China’s reform and opening up, the cross-border flow of Chinese and foreign personnel has become more frequent and the number of Chinese consuls receiving foreign marriage has also increased. According to statistics, in 2011, Chinese consular consuls apply for consular marriage registration to both parties with Chinese nationality
