关于集体合同的协商谈判过程,国外普遍称之为“集体谈判”,我国劳动立法则采用了两个具有中国特色的新术语:“集体协商”和“平等协商”。劳动部颁布的《集体合同规定》中出现了“集体协商”一词,但并未得到认同和响应。中华全国总工会1995年发布的《工会参加平等协商和签订集体合同试行办法》中把集体谈判活动称为“平等协商”。2001年,“平等协商”进入修改后的新《工会法》,正式成为全国人大通过的法律中表述集体谈判活动的法律用语。2003年劳动和社会保障部重新制定的《集体合同规定》仍继续使用“集体协商”来表示集体谈判。
On the process of negotiation and negotiation of collective contracts, foreign countries generally call it “collective bargaining.” China’s labor legislation adopts two new terms with Chinese characteristics: “collective bargaining” and “equal bargaining.” The term “collective bargaining” appeared in the “collective contract provisions” promulgated by the Ministry of Labor but has not been approved and responded to. The All-China Federation of Trade Unions announced in 1995 that the “collective consultation on union participation in equal consultation and signing of collective contracts” refers to collective bargaining as “equal consultation.” In 2001, the “Equal Negotiation” entered a new “trade union law” after the revision and officially became the legal language for expressing collective bargaining activities in the laws passed by the NPC. The “collective contract provisions” re-formulated by the Ministry of Labor and Social Security in 2003 continue to use “collective bargaining” to express collective bargaining.
