2017年2月22日,十二届全国人大常委会第二十六次会议上,国务院提出了关于提请审议反不正当竞争法修订草案(下称“草案”)的议案,此次修法是我国自1993年反不正当竞争法实施以来首次全面修改,既反映了改革开放20余年来我国经济发展的变化,又反映出目前竞争法研究与实务领域的最新进展。笔者希望借此修法之际,结合自己在实务工作中遇到的问题,对此次修法的内容作简要的评析,不当之处还请大家指教。
On February 22, 2017, at the Twenty-sixth Meeting of the Twelfth NPC Standing Committee, the State Council proposed the motion on drawing consideration of the revised draft of Unfair Competition Law (the “Draft”), Is the first comprehensive revision of our country since the implementation of Anti-Unfair Competition Law in 1993. It not only reflects the changes in China’s economic development over the past 20 years since the reform and opening up, but also reflects the latest progress in the field of competition law research and practice. On the occasion of the revision of the law, the author hopes to briefly comment on the contents of the revision in light of the problems encountered in her substantive work. Please also advise on the inadequacies.
