我国目前正处于大力反腐的关键时期,贪污贿赂犯罪的若干问题在学界和实务界引起了强烈的关注。本文想对贪污贿赂犯罪死刑适用的问题从以下几个方面进行进一步的讨论。本文首先通过对我国当前大力反腐的背景以及最新刑事立法的概括引出本文所要讨论的贪污贿赂犯罪死刑适用的问题;其次介绍了死刑的沿革情况;再次对我国最新的关于贪污贿赂犯罪死刑适用的刑事立法进行了归纳;最后对我国贪污贿赂犯罪死刑适用制度进行了进一步的构建。
At present, our country is in a critical period of vigorously fighting corruption. Several problems of corruption and bribery have aroused strong concern in academia and practice circles. This article would like to discuss the application of the death penalty for corruption and bribery from the following aspects for further discussion. This article first introduces the background of the death penalty of corruption and bribery discussed in this article by summarizing the current background of vigorous anti-corruption and the latest criminal legislation in our country. Second, it introduces the evolution of the death penalty. Thirdly, it reapplies the latest criminal of the death penalty of corruption and bribery in our country At last, the system of death penalty for corruption and bribery in our country was further constructed.
