刑事证据规则,是指在收集、核实证据和运用证据分析案情时必须遵守的准则,作为一种法定的证明模式,它要求相同案件应该得到相同的处理。而要做到量刑的一致性,司法人员在收集和审查判断证据时,就必须遵守统一而且具体明确的规则。刑事证据规则的确立有助于查明案件事实,保障人权和保护特定的社会关系与社会利益,拘束裁判者的自由裁量权,增强诉讼程序的可操作性。
The rules of criminal evidence refer to the guidelines that must be followed in the collection and verification of evidence and in the application of evidence to the case as a statutory proof model that requires the same cases to be treated in the same way. In order to achieve the consistency of sentencing, judicial personnel must follow the uniform and specific rules when collecting and examining the evidence for judgment. The establishment of rules of criminal evidence helps to identify the facts of the case, protect human rights and protect specific social relations and social interests, restrain the arbitrators’ discretion and enhance the operability of the proceedings.
