财产征收是对公民财产权的一种严厉限制,其发生必须具有合法、合理的目的且应当按照正当的程序进行。但在现实生活中,国家对公民生产生活中最重要的财产(土地)的征收过程,往往成为了行政权滥用的重灾区。因此,为了防止行政权在土地征收过程中的滥用,就要首先研究清楚在土地征收的整个过程中行政权滥用的源头、表现形式及多发地带等内容。
The collection of property is a severe restriction on the property rights of citizens, and its occurrence must have a legitimate and reasonable purpose and should be conducted according to due process. However, in real life, the state’s acquisition of the most important property (land) in the life and production of citizens often becomes the hardest hit by abuse of executive power. Therefore, in order to prevent the abuse of executive power in the process of land expropriation, it is necessary to first study clearly the source, manifestations and areas of abuse of administrative power in the entire process of land expropriation.
