中华民族是一个重情重义的民族,在婚姻家庭也不例外,然传统婚姻家庭制度限制婚姻自由、男尊女卑严重的制约了婚姻当事人的情感,是对人性的摧残。新中国经过了三次婚姻立法和修正,最高人民法院对婚姻法进行了三次司法解释,已形成了较为完善的婚姻家庭制度,情义和法治的统一是我国婚姻家庭制度的基本特点。
The Chinese nation is a nation of heavy love and sentiment, and it is no exception to the marriage and family. However, the traditional system of marriage and family restricts the freedom of marriage and the masculinity of women and men severely restrict the emotion of the parties to marriage, which is a detriment to human nature. After three new laws and amendments to the marriage in China, the Supreme People’s Court conducted three judicial interpretations of the Marriage Law, forming a relatively complete system of marriage and family. The unification of affection and the rule of law is the basic feature of our country’s marriage and family system.
