现代国家正在为人权的保障而不断探索,宪法的人权保障固然重要,但是存在无法落实的困境,因此国家把人权保障的目光投向了具有保障法益范围广泛以及对违法制裁惩罚严厉的刑法。
Modern countries are constantly exploring for the protection of human rights. Although the constitutional guarantee of human rights is important, but there are difficulties that can not be implemented. Therefore, the state has turned its gaze on safeguarding the interests of law to a wide range of criminal law that punishes harsh penalties.
