目的探讨“超越经营范围经营药品”行为的法律适用问题。方法对不同时间发布的相关法律、法规、行政规章中的有关内容进行比较、分析。结果不同的法律环境下对同一种违法行为有不同的定性与处理。结论现行法律环境下,将“超越经营范围经营药品”行为定性为“无证”经营是值得商榷的。
Objective To explore the legal application of “Beyond the business scope of operating pharmaceuticals” behavior. Methods Relevant laws, regulations and administrative rules promulgated at different times are compared and analyzed. The results of different legal environment for the same kind of illegal behavior have different qualitative and processing. Conclusion Under the current legal environment, it is debatable whether to conduct the operation of “operating drugs beyond the scope of business” as “operating without a license”.
